Terms and Conditions of Sale INTRODUCTION AND GOVERNING LAWThese are the Terms & Conditions of Sale applicable to on-line purchases from Epson Australia Pty. Limited ("EAL"). These conditions should also be read in conjunction with EAL's General Website Terms and Conditions of use. These terms and the laws of New South Wales, Australia, apply to all transactions for the purchase of EAL products ("Products") from EAL through its web site at www.experience.epson.com.au and any associated web page (the "Site"). These terms represent the complete Agreement between EAL and the Buyer covering the sale of Products from this Site. Except for terms implied by applicable legislation, EAL does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. The Buyer's completion of the Order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by EAL. PRICES STOCK
AVAILABILITY ORDER DELIVERY AND CANCELLATION (a) Quantity and description of Products The Buyer must complete all information requested on the Order form before the Order is processed by EAL. EAL will not accept orders:·
(a) From trade customers who are buying Products for resale; DELIVERY Delivery of a Product will occur between 2-6 business days after acceptance of an Order. A Buyer cannot arrange collection of Orders from Epson either in-person or via alternative courier. The Buyer acknowledges that EAL may, from time to time, be subject to production, delivery or other unforeseen delays and that EAL may allocate distribution of Products ordered among its customers at its sole discretion. If Buyer's Order has not been delivered within a reasonable time, the Buyer should contact EAL at: weborders@epson.com.au If no one is available at the delivery address to receive the Products, EAL's delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. EAL reserves the right to make partial delivery of an Order. PAYMENT CANCELLING
AN ORDER If the Buyer's entire order is cancelled prior to shipment EAL will apply a credit to the Buyer's credit card and may also aply a cancellation fee. If an Order has already shipped EAL's normal returns and exchanges procedure will apply. DEAD ON ARRIVAL (DOA)A Product is deemed to be DOA if it fails to function according to its specifications either on set up by the Buyer or within 14 days of its purchase date. The time period for calculating DOA commences two working days after delivery of a Buyer's Order. If the Buyer believes that a Product is DOA, it must phone EAL's customer service on 1300 361 054 to report the DOA status. If it considers the Product to be DOA, EAL will issue a Return Material Authorisation (RMA) Number and will send a DOA label, consignment note and return instructions to the Buyer. EAL will pay the freight cost associated with the return of a DOA Product, provided that the Buyer uses the EAL nominated freight carrier. EAL will deliver a replacement Product to the Buyer promptly upon receipt of a product that it considers to be DOA. FREIGHT METHODS EAL will arrange delivery of all Products to the Customer using its nominated freight carriers. A Buyer must not arrange its own courier to collect the Products from EAL. INCORRECT ORDERING OF CONSUMABLES If the Buyer incorrectly orders a consumable, it may be returned to EAL within 7 days of receipt and may purchase a replacement item from the EAL website. Once EAL receives the original consumable, it will issue a credit against the Buyer's nominated credit card, provided that the returned Product is in new condition with its original packaging unopened. Before returning an incorrect consumable, the Buyer must obtain from EAL a Return Material Authorization (RMA) Number and return instructions. At its own cost, the Buyer must return the consumable to EAL within seven (7) days after receiving the RMA Number. INCORRECT SUPPLY OF ORDER If due to a warehouse or other error on the part of EAL, the Buyer receives a Product which does not conform to its Order, the Buyer must contact EAL within 7 days of receipt of the Product and may purchase a replacement Product from the Site, after returning the original Product to EAL, provided that the returned Product is in new condition with its original packaging unopened. Before returning a Product, the Buyer must obtain from EAL a Return Material Authorization (RMA) Number and return instructions. PRODUCTS DAMAGED IN TRANSIT Claims for alleged damage to Products caused in transit from EAL to the destination specified by the Buyer must be notified to EAL as stated below within 48 hours of receipt of delivery and the consignment note must be marked as "Received Damaged". The Buyer must contact the EAL Website Administrator by e-mail to webOrders@Epson.com.au and obtain a Return Material Authorisation (RMA) Number and return instructions. The Buyer must also supply a copy of the consignment note to EAL. DELIVERY OUTSIDE AUSTRALIA EAL is unable to accept Orders or deliver to addresses outside Australia. AMENDMENT OF TERMS AND CONDITIONS EAL may revise these terms and conditions from time to time. Buyers should therefore periodically visit this page to familiarise themselces with any such revisions.
